On December 6, the store posted content showcasing nicotine vape products, including brands like Breeze, Geek Bar, Raz, and South. The following day, a Facebook Reel featured various alcoholic beverages. Although some of these posts have since been deleted, concerns remain regarding their compliance with federal regulations and social media platform policies.

Federal Regulations on Alcohol and Tobacco Advertising

The Alcohol and Tobacco Tax and Trade Bureau (TTB) enforces regulations under the Federal Alcohol Administration Act (FAA Act) concerning the advertising of alcoholic beverages. These regulations apply to all forms of media, including social media platforms. In November 2024, the TTB issued Industry Circular 2024-1, providing updated guidance on social media advertising for alcohol beverages. The circular emphasizes that advertisements must include mandatory statements and avoid prohibited practices or statements.

Alcohol and Tobacco Tax and Trade Bureau

Regarding tobacco products, the Federal Cigarette Labeling and Advertising Act and the Family Smoking Prevention and Tobacco Control Act impose strict limitations on advertising, especially in mediums accessible to minors. The Food and Drug Administration (FDA) oversees the regulation of tobacco product advertising to ensure it does not target individuals under the legal purchasing age.

Social Media Platform Policies

Facebook’s Advertising Policies explicitly prohibit the promotion of tobacco products, including vapes, and place stringent restrictions on alcohol advertisements. These policies are designed to prevent exposure to underage users and to comply with legal standards. By showcasing nicotine vape products and alcoholic beverages, Dean & Donna’s may have violated these platform-specific guidelines.

The promotion of nicotine and alcohol products on social media platforms accessible to a broad audience, including minors, raises significant public health concerns. Exposure to such advertising can influence underage individuals, potentially leading to early initiation of substance use.
