TOLEDO — A 55-year-old man charged with murder in the April shooting death of a north Toledo man has pleaded not guilty by reason of insanity, WTOL 11 reported Monday, Oct. 19.
Elmer Winters is charged in the death of Leon Oldham, 44, who was shot April 28. Winters entered the plea Thursday, Oct. 15, in Lucas County Common Pleas Court, according to court records cited by WTOL.
The court referred Winters to its diagnostic and treatment center for a competency evaluation and rescheduled the case to allow time for the results. His next court date is Dec. 7.
A plea of not guilty by reason of insanity is a formal defense under Ohio law. It is separate from the question of competency, which looks at whether a defendant can understand the proceedings and help with his own defense. The court has not ruled on either issue.
A Lucas County grand jury indicted Winters on Oct. 1 on two counts of murder and one count of felonious assault. WTOL reported the charges carry repeat violent offender and firearm specifications.
Winters was arrested in Minnesota in August after he was identified as a suspect, and he was later returned to Ohio and booked into the Lucas County Jail. WTVG 13abc reported in September that he had been wanted on the murder and felonious assault charges and was brought back from Minnesota.
13abc’s I-TEAM also featured Oldham’s killing in a “Case Files” report in September.
Bond remains set at $5 million on the murder charges and $100,000 on the felonious assault charge, with no 10 percent option, WTOL reported. Winters is also under a court order to have no contact with Oldham’s family.
Jail and case information is available from the Lucas County government website. Anyone with information about the case can contact the Toledo Police Department.

The charges are accusations only. Winters is presumed innocent unless and until he is proven guilty in court.
